Judges on the retention ballot
Florida's Supreme Court justices and appeals court judges don't run against opponents. Voters decide whether each one stays in office for another six years (yes or no). Trial judges who face opponents are elected in nonpartisan races.
- Each justice and appeals judge is on the ballot as a yes/no question: "Shall Justice (or Judge) ... be retained in office?" A majority of yes votes keeps them for another six-year term; if no wins, the governor appoints a replacement from a list sent by a nominating commission. source: ballotpedia.org
- Supreme Court justices are on every Florida ballot. Appeals court judges are on the ballot only in the counties their court covers. source: ballotpedia.org
What each court does
- Supreme Court: Florida's highest court (7 justices). It has the final word on Florida law, hears every death penalty appeal, and checks that citizen-proposed amendments are clear enough to go on the ballot. Justices are appointed by the governor and then face yes/no retention votes every six years. source: flcourts.gov
- District Court of Appeal: Florida's middle-level appeals courts (six of them, each covering a region). They hear most appeals from trial courts, and for most cases their ruling is the final word. Judges face yes/no retention votes every six years. source: flcourts.gov
