2. The article

Congress created a federal power and flood-control agency in 1933 that brought electricity to a poor region, but built dams on land where thousands lived, hired and housed Black workers unequally, took on debt, and in 2008 caused a major coal ash spill.

In brief

Congress created the Tennessee Valley Authority on May 18, 1933, to control floods, improve navigation and provide power. Private companies had electrified only 3 percent of the valley's farms by 1933, and by 1946 electricity reached 668,752 households. Building Norris Dam, which began in October 1933, meant removing families and moving about 5,200 graves; sources give figures from about 3,000 families to 2,841 families, and the agency's reservoirs displaced an estimated 72,000 people by 1946. A 1934 article in Opportunity reported that Black residents were passed over for jobs, kept off the dam work and excluded from the planned town of Norris. In 2008 a dike failure at the Kingston plant released about 5.4 million cubic yards of coal ash, and cleanup workers later sued the contractor Jacobs Engineering, which settled in 2023. TVA also carries a $30 billion statutory debt limit. The record shows broad benefits, real removals and exclusions, and a public agency whose costs were set by decisions outside the valley's voters' reach.

Graves relocated About 5,200 History.com; Wikipedia

(Wikipedia, Norris Dam; opened.) These do not agree: "families" and "people" are different units, and the Wikipedia article cites two figures. I did not find a TVA or archival count of families removed for Norris. The Tennessee Encyclopedia adds that many removed people "later said they were economically better off in the long run." That is a reported summary, not data I could check.

What this case shows

  1. A federal statute made a regional utility, and residents of the valley did not vote on where the dams went. The 1933 Act sets purposes in public law. Families in the reservoir area were removed, with counts ranging from about 3,000 people to 72,000 people overall depending on scope.
  2. Benefits and costs fell on different people. Electricity and income rose across the valley (3 percent of farms electrified in 1933; income from 44 to 61 percent of the national average by 1953). The people moved from Norris and the Black residents told the agency would not employ them at the dam bore costs that were not matched by those benefits, according to Clayton and Walker.
  3. Exclusion is documented in a contemporary article and in later scholarship. Clayton's 1934 report and the Loyola essay agree on unequal services and hiring; the Norris town exclusion rests on Clayton and on Loewen via Wikipedia.
  4. Public power meant public debt and public rate decisions. A $30 billion statutory ceiling, a 1959 self-financing rule and a 1970 rate increase are all matters of public record.
  5. The Kingston spill shows a regulatory gap and a worker-protection dispute. GAO found no direct federal rule on coal ash impoundments in 2009; workers later sued a contractor, and a court rejected the contractor's immunity argument.

The strongest objections, and our answers

  1. Objection: TVA lifted one of the poorest regions in the country. Mitigation: we state the figures. The Tennessee Encyclopedia says many of those removed later felt better off. We do not weigh that against the removals.
  2. Objection: TVA officials said Black workers were hired in proportion and paid equally. Mitigation: Clayton reports exactly that and says he had no facts to contradict it, then reports the exam, committee and Norris Dam statements.
  3. Objection: the sundown-town label is secondary and the NRHP nomination is silent. Mitigation: we show that the label comes from Wikipedia citing Loewen, which I did not open, and that Clayton (1934) is the closest contemporary source.
  4. Objection: Kingston was an industrial accident, not a TVA design failure, and the worker case blames a contractor. Mitigation: the Sixth Circuit rejected Jacobs's immunity theory and a jury found against Jacobs; TVA's indemnity is reported but is a newspaper's account. We make no claim about intent.
  5. Objection: debt and rate stories are told by agency critics. Mitigation: the debt figures come from GAO.
