2. The article

A chemical company buried about 22,000 tons of waste in a canal, sold the land to a school board for $1, and families later lived and sent children to school on it; after residents organized in 1978, two federal emergencies and the Superfund law followed.

In brief

From 1942 to 1952, Hooker Chemical buried about 22,000 tons of waste in an abandoned canal in Niagara Falls, New York. In 1953 it sold the site to the school board for $1 and included a clause releasing the company from future claims. A school opened in 1955, and hundreds of homes were built nearby. In the 1970s, chemicals seeped into basements, and in August 1978 residents formed the Love Canal Homeowners Association. The state declared an emergency on August 2, and President Carter declared a federal emergency five days later. Congress held 13 hearings with 106 witnesses, and a second emergency in 1980 led to the relocation of hundreds more families. Congress passed the Superfund law that December. In 1995, Hooker's successor agreed to pay $129 million, and EPA removed the site from its priority list in 2004. The health effects remain debated. What the record shows is that families learned what lay beneath their homes largely because neighbors organized.

What this case shows

  1. The key fact was in a deed, not in public view. A liability release traveled with the land from a company to a school board. The 1953 buyers were a public body; the later families were not. The record shows a city lawyer warned of "risk and possible liability" yet the sale went ahead. (Buffalo glossary)
  2. Residents had to build their own evidence and their own voice. The Love Canal Homeowners Association formed in August 1978, and relocation expanded only after hearings, arrests and a detention of EPA officials. About 700 families first outside the line later got the second emergency. Public pressure, not a routine process, moved the boundary. (UB timeline; Levin Center)
  3. Open hearings produced a law. A House subcommittee held 13 hearings with 106 witnesses from October 1978 to June 1979, and Congress passed Superfund in December 1980. This is our question answered well: public record, then public rule. (Levin Center)
  4. Even the cleanup record is not simple. EPA says all response actions are complete, but waste remains above unrestricted-use levels, and deed restrictions bind later owners. People can read the controls; they still need to know to look. (FR 2004)
  5. Science and courts did not settle the harm quickly. The first chromosome study was criticized and a 1983 CDC study found no difference; a 2008 state study found a malformation signal and urged caution. Residents acted on a fear that years of data only partly confirmed. (CSM; CDC; NYSDOH)

The strongest objections, and our answers

  1. Objection: Hooker disclosed the waste and sold the land in good faith. The deed mentioned the chemicals, and the board insisted on the purchase, with a lawyer's warning on record. Mitigation: We report Hooker's position. The 1994 court found negligence but not reckless disregard, and we do not call the company's conduct criminal. The court also found Hooker knew its wastes were toxic and knew of seepage by 1944.
  2. Objection: The school board and local government bore responsibility too. Mitigation: Yes. The board bought the site, built a school and sold the rest; local agencies approved development. The Occidental settlement also gave the U.S. an $8 million credit for the claim that federal agencies shared blame. We make no claim about who was most at fault.
  3. Objection: The health harm was overstated. Mitigation: The evidence is mixed and we show it: a criticized 1980 study, a null 1983 CDC study, and a 2008 state study that found total cancer within the expected range and malformations about twice the expected rate. Our question does not depend on proven harm; it depends on residents and officials acting without clear data, and on who could see the data.
  4. Objection: The system worked; it is a Superfund success story. Mitigation: EPA calls it a "symbol of our success." We include that. It also took two emergencies, a lawsuit begun in 1979 and settled in 1995, and citizen action.
  5. Objection: Wikipedia and local timelines are weak sources. Mitigation: We use Wikipedia for background and checked its claims against EPA, DOJ and the court. Where it conflicted (NPL date, $98 million figure), we followed the primary source or dropped the claim.
